Whether authorities will pursue you or not is another matter (I've never heard of people getting done in for using flashcarts in Australia for example, but rather the distributors are heavily punished). My understanding was that in France, circumventing copyright protection or DRM is illegal in a similar way to how it is in the US. In addition, the EU's Copyright Directive makes it very clear that circumventing either copyright protection or copy protection is illegal.In France, the law authorizes you to have a copy of anything only if you possess the original. In this case, in France, we won't pursue you because you have downloaded a copy of a game that you already have the cartridge.

Backups are not considered piracy.It's illegal since you're downloading it. If you backed up your own and then your copy was destroyed, I believe that would be okay. It's been a good while since I looked into it though.
