Just to confirm..

To be safe, you should be on 3.0.X or lower. 3.0.X is currently a WIP while 2.X.X has kernel exploits.

Anything on 4.0.X should be avoided since that is stuck on userland for now.

So if Tesla says put out an update that would take away a feature, do you really think it's a good idea to let an 8-year old make that decision? Some updates take away features. Some updates come with changes to the user agreement, which a child can not legally agree to. It even says when you first set up a console that an adult needs to do it. Except a child could easily ignore that or not even be able to read it. It's not much of a contract if one party can force the change of terms at any time with no way out.

Accepting a EULA and updating the system are TWO COMPLETELY DIFFERENT THINGS. That really should go without saying, don't you think? Not to mention as YOU stated, it's not contractual. So, it's not entirely legally binding. It almost never pertains to updates, either.

You keep making points that can't really apply to system updates. Blocking games based on rating is one thing, but for normal people who aren't going to exploit the system, they don't have any reason to not update the system. So why would nintendo make it so updates can easily be blocked? The only one to benefit from that would be the ones using console exploits, which nintendo doesn't want you doing hence why they don't have that. On top of that there is no real reason to block internet settings. At worst for Nintendo a child will merely cause the device to disconnect from the correct network. So again this would only really benefit those using exploits.

Not true. The child could add a new internet connection. The new one may be unrestricted, allowing access to porn, violence, child predators, etc. This stuff used to be locked. Nintendo thought it was a good idea to lock it previously. They just got lazy with the switch.

It's also practically legally binding because they block downgrades. If they change the EULA with the update, and you don't agree, you have to stop using the system entirely. Instead of just dealing with the consequences of not updating, you can't use it all. no refund.

If Tesla doesn't have parental controls, of course, the child has access.

The EULA doesn't really apply to the system. More or less the services involved. Like online play. I've never read (yes, I actually read a few) a EULA where you're not allowed to use the system if you don't agree. Just doesn't happen

I want piracy so I can get games like Monopoly, Just Dance, NBA2k, ie, games that aren't worth buying. Yes they are. The bloody thing can update itself while you aren't even home. It happened all the time on the Wii U. Mine updated one time while I was on vacation. They could start doing that with the Switch at any time.

You do realize Nintendo tries to block homebrew in a way that won't make people think it's because of homebrew and then get it. Having all the sudden auto updates which are unable to disable would be a huge hint what Nintendo is trying to do.

People like you are why the homebrew scene is so frowned upon by outsiders. If you can't afford games for the system you don't deserve to use the system. The homebrew devs aren't going to give you backup loading, and unless you are on 1.0.0 you'll need whatever TX has anyway to get decent piracy. Without it you won't get high enough privilege escalation to do piracy in any sane way.

It's quite simple. The Switch needs better parental controls and no forced updates. It should be like a phone or computer. You cant make changes without the password. Why is that so hard?

^ This 100%, when someone buys a console they will most likely get at least one game to play on their new console, but that costs a lot. It's not like people are buying a console only for piracy and wait until they can get free games.
